Thailand’s Securities and Exchange Commission has initiated a public consultation on proposed regulatory amendments designed to allow local intermediaries to offer retail investors access to select digital asset derivatives traded on foreign exchanges. Under the draft framework, eligible offshore contracts must closely mirror digital asset derivatives permitted within Thailand regarding underlying tokens, maturity structures, leverage caps, and settlement procedures.
Additionally, the execution venues must utilize central counterparty clearing mechanisms and fall under the oversight of recognized international regulatory bodies. Non-compliant foreign products that fail to satisfy these strict conditions will remain restricted exclusively to institutional investors, whom the SEC views as better equipped to evaluate complex risk profiles.
This move represents the latest effort by Thai regulators to integrate digital asset products into the national financial framework. The SEC formally classified cryptocurrencies and digital tokens as permissible underlying assets under the Derivatives Act through a notification on March 5, 2026, and is actively coordinating contract specifications with the Thailand Futures Exchange.
While existing regulations permit intermediaries to offer foreign derivatives that resemble domestic instruments, the SEC noted that overseas crypto products require specialized oversight due to significant structural variations. The public feedback window remains open through September 30, 2026, though the SEC has not yet announced an official implementation timeline for the final rules.
