New York Attorney General Sues Coinbase and Gemini Over Prediction Markets

New York’s Attorney General has filed lawsuits against Coinbase and Gemini, claiming their prediction market platforms operate as illegal gambling under state law.

New York State Attorney General Letitia James has filed lawsuits against Coinbase and Gemini, alleging that both companies are illegally offering gambling-like services through their prediction market platforms. The lawsuits claim that users are effectively betting on events such as sports outcomes and political elections in violation of New York law.

In the filing, the Attorney General argued that these platforms constitute unlicensed gambling operations rather than legitimate financial products. The state is seeking significant penalties, including $2.2 billion from Coinbase and $1.2 billion from Gemini, as well as restitution and forfeiture of alleged profits.

A key issue raised in the complaint is age eligibility. New York law requires participants in mobile sports betting to be at least 21 years old, but the platforms reportedly allow users aged 18 and above to participate. According to James, this exposes younger users to addictive betting environments without sufficient safeguards or regulatory protections.

The legal action comes amid growing uncertainty around prediction markets in the US, where regulatory authority is divided between state agencies and federal regulators. The Commodity Futures Trading Commission has previously asserted jurisdiction over certain prediction market products, arguing they fall under federal oversight rather than state gambling laws.

Coinbase has maintained that its prediction market offerings are federally regulated. Chief Legal Officer Paul Grewal said the matter is already being addressed in federal court and defended the company’s position that Congress intended these markets to be regulated at the federal level.

Meanwhile, Gemini also faces scrutiny despite earlier approval from the CFTC to operate its prediction market product.
